DD to RTGs ( NEED PVT LTD COMPANY FRAUD PROCESS (ADV - Financial)
Let me make u understand the legal complication.
1. Saurabh co 2. Client who has 50cr surplus fund and making dd in favour of 1. 3. Co to which 1 is doing rtgs but unrelated to 4 4. Donor co actual 5. Premium receiving co unrelated to 2
Now think of the scenario 2 will be making 50cr pmt to 4 4 will be making 150cr pmt to 5
If thr is any issue between 2 and 4, how will 1 be able to encash the dd legally ? In the absence of any relation between 3 and 4, 1 cannot encash the dd issued by 2 bcoz it has done rtgs to 3. No court will allow this bcoz either 3 is a sister concern fulfilling all the norms or it is a distinct separate co.
This has lead me to conclude that this post is basically to fraud ppl of the booking amount.
